The Leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu, on Wednesday, hinted the court on his desire to settle out of court in the terrorism charges brought against him by the Federal Government.
Kanu appeared before Justice Binta Nyako in court to face trial on the remaining seven-count terrorism charges against him.
At the resumed hearing of the suit, counsel to the detained IPOB leader, Aloy Ejimakor, informed the judge, that he has discussed with the prosecuting counsel, Chief Adegboyega Awomolo, SAN, on the possibility of an out of court settlement on the case, in line with Section 17 of the Federal High Court Act.
The Act states: “In any Proceeding in the court, the court may promote reconciliation among parties thereto and encourage and facilitate the amicable settlement thereof.”
Awomolo in his response said it is not in his place to initiate an out of court settlement adding that it can only be handled by the Attorney General of the Federation (AGF) who has the powers to approach the court for out of court settlement.
Awomolo said, “ It is not me that would go to my boss to tell him I want this case settled out of Court.”
Justice Nyako then asked the defense counsel to approach the AGF and see if he will opt for it and inform the court of his decision
Earlier, Ejimakor moved an application challenging the jurisdiction of the court to hear the matter, but Justice Nyako dismissed the application and said he has an option to appeal the ruling.
The judge subsequently adjourned proceedings to September 24, 25, & 26, 2024, for continuation of trial.
