Judgment in the appeal filed by candidate of the Peoples Democratic Party (PDP) Alhaji Atiku Abubakar against the election of President Bola Tinubu has commenced.
Atiku’s appeal was called shortly after the seven-man panel, led by Justice John Okoro, took their seats for judgment.
Atiku is seeking the nullification of Tinubu’s victory at the February 25 presidential election on account of alleged malpractice, non-compliance with the electoral laws and corrupt practices.
Besides, he is challenging Tinubu’s participation in the poll, claiming that the president violated Section 137 of the Constitution.
In addition, Atiku argued that it was wrong for the Independent National Electoral Commission (INEC) to have gone ahead to announce Tinubu as the winner when he did not score 25 percent of votes cast in the Federal Capital Territory.
But a five-member panel of the presidential election tribunal on September 6, dismissed Atiku’s petition on grounds that he did not proof the allegations he made concerning the poll.
The dismissal prompted the current appeal at the apex court which judgment is about to be delivered.
